Dispute Resolution: Mandatory Arbitration
1. Acceptance of Terms
By accessing or using the Platform, including viewing building profiles, creating an account, submitting information, or claiming ownership of a property listing, you agree to be bound by these Terms of Use. If you do not agree, you may not use the Platform.
2. Definitions
For clarity:
- "Platform" – this website/app, including all features, pages, APIs, and services.
- "User" – any visitor, registered or not.
- "Owner" – a person or organization asserting control over a building listed on the Platform.
- "Listing" – a building, apartment, or related property profile.
- "User Content" – information, text, photos, corrections, or materials submitted by Users.
- "Platform Content" – information created by the Platform, including descriptions, processed data, and system-generated content.
- "Open Source Data" – publicly available, factual, non-copyrighted information (e.g., addresses, unit counts, year built).
3. About the Platform
The Platform provides:
- Discovery of buildings and property information;
- The ability for Owners to claim or manage building listings;
- Tools to contribute or update data about buildings;
- Mechanisms for Users to report inaccuracies or request corrections.
The Platform does not:
- Act as a broker, agent, or representative;
- Guarantee the accuracy, completeness, or availability of any listing;
- Verify ownership of buildings beyond reasonable procedures.
4. Sources of Data
Building listings may be created by:
- Platform Team – using Open Source Data, public information, and photos taken by the Platform.
- Users – submitting information voluntarily.
- Owners – claiming or managing property profiles.
The Platform may also generate unique descriptions where factual information is incomplete.
5. Ownership of Listings
Adding a building to the Platform does not imply any rights over the property.
Owners may:
- Create listings for their properties;
- Request control over a listing created by the Platform;
- Submit corrections or updates.
The Platform may request reasonable proof of ownership or authorization before transferring listing control.
6. Requests to Remove Listings
Because building information (e.g., address, exterior appearance, factual attributes) is publicly observable:
- The Platform generally does not remove factual building profiles that are created using lawful and public information.
- Owners may request removal if:
- The listing includes copyrighted materials;
- The listing includes inaccurate or sensitive information;
- The listing violates privacy, safety, or legal requirements.
The Platform retains the final decision on removals.
7. Intellectual Property
7.1 User Content
Users grant the Platform a non-exclusive, worldwide, royalty-free, perpetual license to:
- Use, display, publish, reproduce, modify, and distribute User Content;
- Convert material into processed data, summaries, or structured entries;
- Maintain the content in backups.
Users represent that they own or have rights to submit the content.
7.2 Platform Content
Descriptions, processed information, photos taken by the Platform, and all system-generated materials are owned by the Platform and may not be copied without permission.
7.3 Third-Party Content
Some materials may belong to third parties. Removal will be handled under a DMCA-like procedure (Section 15).
8. Accuracy of Information
The Platform provides information "as is". We make reasonable efforts to keep listings accurate, but:
- Data may be incomplete or outdated;
- The Platform does not guarantee correctness;
- Users rely on information at their own risk.
Owners are encouraged to keep information current.
Pricing Disclaimer: Prices, availability, and rental terms displayed on the Platform are provided for informational purposes only and may be subject to change without notice. The Platform does not guarantee the accuracy or real-time availability of pricing information. Prices may differ from those offered directly by property owners, managers, or leasing offices. Users are strongly encouraged to verify all pricing and availability directly with the property owner or authorized representative before making any decisions.
9. User Responsibilities
Users agree not to:
- Submit false, misleading, or unauthorized content;
- Attempt to claim buildings they do not own;
- Scrape or copy Platform data without permission;
- Interfere with security or operation of the Platform;
- Use the Platform for unlawful purposes.
10. Claiming a Building
To claim a Listing, Owners must:
- Register an account;
- Submit evidence of ownership or authorization;
- Agree to maintain accurate information.
The Platform may refuse or revoke claims at its discretion.
11. Platform Rights
The Platform reserves the right to:
- Modify or remove listings;
- Edit or reject submitted content;
- Suspend or terminate accounts;
- Update the Platform features and functionality.
12. Limitation of Liability
To the fullest extent permitted by law:
- The Platform is not liable for any damages resulting from use of the Platform, including reliance on incorrect or incomplete information.
- The Platform is not responsible for interactions between Users and Owners.
- The Platform is not responsible for third-party content, links, or listings created by users.
Your sole remedy for dissatisfaction with the Platform is to stop using it.
13. Indemnification
Users agree to indemnify and hold the Platform harmless against claims arising from:
- Submitted content;
- Misuse of the Platform;
- Violation of these Terms;
- False claims of ownership.
14. Privacy
Use of the Platform is also governed by our Privacy Policy, which explains how we collect and handle personal information.
15. Copyright / Content Removal Procedure (DMCA-like)
If you believe your copyrighted materials were used without permission, you may submit a notice including:
- Your contact details;
- Description of the material;
- Link to the allegedly infringing content;
- Proof of your rights;
- A statement that the complaint is made in good faith.
The Platform may remove or disable the content while investigating.
Knowingly submitting false notices may result in termination.
16. Changes to Terms ("Early Changes")
We may update these Terms at any time. If the changes are material, we will notify Users by placing a notice on the website.
Continued use of the Platform after changes constitutes acceptance.
17. Dispute Resolution & Arbitration
All disputes will be resolved by binding arbitration in New Brunswick, Canada, under the rules of an established arbitration provider.
Users waive the right to participate in class actions.
18. Governing Law
These Terms are governed by the laws of New Brunswick, Canada, without regard to conflicts of law principles.
